Terms of Use

1. General

These Terms of Use ("Terms") govern the use of the ograda.hr website and related services provided by Fenrir d.o.o., Mljekarska ulica 29, 10040 Zagreb, OIB: 63618289113 ("Company", "we", "our").

2. Acceptance of Terms

By using our website and services, you agree to comply with these Terms. If you do not agree with any part of these terms, please do not use our services.

3. Description of Services

ograda.hr provides fence and gate sales services, including:

  • 3D mesh fences
  • Lamella fences
  • Glass fences
  • Fence gates
  • Fence delivery and installation
  • On-site measurement and technical support

4. Right of Withdrawal and Returns

A buyer who is a consumer (a natural person purchasing outside their trade or profession) has the right, under Croatian consumer law, to withdraw from a distance contract within 14 days of receiving the goods, without giving a reason.

  • IMPORTANT EXCEPTION: the right of withdrawal does NOT apply to goods made to the buyer’s specifications or clearly personalised. Glass fences and custom gates are made to your dimensions, so this exception applies to those deliveries. Before you order we will always tell you whether the right of withdrawal applies to your particular order.
  • Withdrawal must be declared in writing to info@ograda.hr, or by post to the company address, no later than the final day of the 14-day period.
  • We refund the amount paid within 14 days of receiving your notice of withdrawal, using the same means of payment you used, unless expressly agreed otherwise.
  • The direct cost of returning the goods is borne by the buyer.
  • The buyer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature and functioning.
  • Buyers who are not consumers (companies, sole traders and other business entities) have no statutory right of withdrawal; the terms agreed in the quote and contract apply to them.
  • This section does not affect the buyer’s statutory rights in respect of defective goods (liability for material defects runs for two years from delivery), nor any manufacturer warranty.

5. User Responsibility

The user agrees to:

  • Use the products exclusively for the agreed purposes
  • Provide a suitable base and access for delivery and installation
  • Immediately report any defects or damage
  • Install the products in accordance with the manufacturer’s instructions

6. Limitation of Liability

The Company shall not be liable for indirect, incidental or consequential damages arising from the use of our services, except in cases provided by law.

7. Intellectual Property

All content on this website, including text, images, logos and design, is protected by copyright and is the property of the Company.

8. Data Privacy

The collection and use of personal data is governed by our Privacy Policy, which is an integral part of these Terms.

9. Changes to Terms

The Company reserves the right to modify these Terms at any time. Changes take effect upon publication on the website.

10. Applicable Law

These Terms are governed by Croatian law. All disputes shall be resolved before the competent courts in Zagreb.
